CFPB releases third draft of a new Settlement Statement

Consumer Financial Protection Bureau (CFPB) has released the third draft of a new Settlement Statement form that combines TIL disclosures and the HUD-1 to explain final loan terms and closing costs to consumers.

There are two drafts of the new, combined form, Butternut and Hemlock. CFPB is again asking for your input on how these final-stage closing forms work with the draft application form which will replace the GFE. The forms are intended to help consumers better understand the differences between their estimated and final loan terms and settlement costs.

They need to hear from consumers, lenders, and settlement agents. In other words: they need to hear from the people who have to use these disclosures.

The Dodd-Frank Act requires them to integrate the two disclosures you currently receive when you close on a mortgage loan: the HUD-1 Settlement Statement and final Truth-In-Lending disclosure. Their goal is to make this one combined form that is easier for both consumers and industry to understand and use. Keep in mind that this is the final disclosure consumers receive either shortly before or at closing. It provides borrowers with the important information like the loan terms, closing costs, and requirements for the loan.

Who Is NAILTA?

The National Association of Independent Land Title Agents (NAILTA) is a non-profit trade association that represents the interests of independent title insurance agents and independent real estate settlement professionals from across the United States. It was created by independent real estate settlement professionals to further the agenda of small business owners from within the title insurance, abstracting, surveying, and real estate community who lack representation at local, state and national levels. As an independent agent and settlement service professional, your voice is important and we want to hear from you! Join NAILTA today – it’s quick and easy!

NAILTA seeks to:

1. Restore transparency and credibility to the land title process and preserve an objective and impartial role at the closing table to improve the consumer experience.

2. Address the proliferation of controlled business arrangements and eliminate conflicts of interest between title agents and their referral sources, as well as, between all real estate settlement service providers and their sources of business.

3. Establish a minimum search standard for title examinations to restore faith in the system of land title.

4. Knit together common interests and concerns from across the country and across the entire spectrum of real estate settlement service providers to successfully advocate for independent agents and their like-minded partners in the real estate settlement service community in order to effect positive change on the title industry.

How Does NAILTA Work?

This website serves as a forum for discussion among members, provides news updates and programming notes and helps to unite independent settlement professionals from all corners of the United States. Each year, NAILTA holds an annual spring conference in which speakers from across the country gather to discuss important independent settlement professional issues. Our conferences and special programs provide valuable continuing education credits for title insurance and real estate settlement professionals. Volunteer committees make progress on key issues throughout the year. We strive to educate the public, legislators, and state administrators on issues of importance to our industry, including, controlled business arrangements, minimum search standards, industry solvency concerns, risk management tools, etc. See our recent accomplishments for more information.

What Do I Get For My Membership?

Most title insurance associations are funded and controlled by the largest national underwriters in the United States.  Thus, the agenda of each association is catered towards protecting and promoting the interests of the largest underwriters.  NAILTA is an organization that recognizes the inequity of top-down advocacy.  NAILTA helps support the small business owners, title agents, and other real estate settlement service providers who have been left out of the underwriter-dominated effort to improve the title insurance industry.  Therefore, being a member of NAILTA gets you access.  Access to current issues in the title insurance industry.  Access to the policymakers that represent independent title agents and real estate settlement professionals.  Access to the place where improvements can be made in the title insurance industry and the broader real estate settlement professional community.
