The National Association of Independent Land Title Agents (NAILTA) has issued its most recent position paper on the Mortgage Electronic Registry Systems, Inc. (MERS) and Senator Bob Corker’s S.B. 1834 which would create a federal registry system known as MERS 2.0.

The Mortgage Electronic Registration System (MERS), a private corporate experiment gone awry, has siphoned tens of millions of dollars away from state and county government recording offices and prevented those public officials from investing in safer and more accessible land title record system upgrades and improvements.

Last month, independent title agents in Indiana and Louisiana gathered to organize their own state independent land title agent organizations with the help and support of NAILTA. The Indiana Association of Independent Land Title Agents (IAILTA) and the Louisiana Association of Independent Land Title Agents (LAILTA) are now fully operational and seeking additional members.

What is an independent land title agent? The question has eluded the National Association of Insurance Commissioners, the various state departments of insurance, the U.S. Department of Housing and Urban Development and state and national land title associations for over a century. No other title insurance constituency or organization has ever created an adequate definition to describe an independent land title agent -- until now.
